仲裁机构的民间性,实际上是一个无需争议的逻辑结论。但在我国而言,这一民间化道路却走得非常的艰难。尽管《仲裁法》于颁行之时的设想就是实现我国的仲裁及仲裁机构民间化,但是从这十几年的实践来看,行政化倾向似乎未有改变甚而有严重的趋势。本文回顾了我国仲裁机构民间化道路的发展,指出了现实中仲裁机构民间化难的原因及仲裁机构民间化的优势所在,并给出自己的相应建议,以期我国仲裁机构民间化道路的顺利行进。
The non-governmental nature of the arbitration institution is actually an indisputable logical conclusion. However, in my country, this path of civilization has come a long way. Although the enactment of the Arbitration Law was enacted at the time of its enactment to bring about the triad of arbitration and arbitration institutions in our country, judging from the practice of more than a decade, there seems to be no change in the tendency of administrativeization, even with serious trends. This paper reviews the development of the civil road to arbitration institutions in our country, points out the reasons why the arbitration institutions are non-governmental in reality and the advantage of the institution of arbitration institutions, and gives our own corresponding suggestions to smooth the smooth progress of the civil road in our country’s arbitration institutions .
