商标商品化是西方商业社会广泛存在的一种商标使用形式,也是目前知识产权研究的前沿课题。上世纪80年代开始,随着改革开放的推进,商标商品化开始在我国扎根发展,目前已成为一个重要的商业现象,但是我国对商标商品化行为缺乏立法规范。本文旨在对商标商品化在我国的发展和立法状况进行分析,力图引起我国立法和学术界对该现象的重视和研究。
Commercialization of trademarks is a widely used form of trademark in western commercial society. It is also a frontier subject of intellectual property research. Since the 1980s, with the promotion of reform and opening up, the commercialization of trademark has begun to take root in our country. At present, it has become an important commercial phenomenon. However, our country lacks legislative norms on the commercialization of trademark. The purpose of this paper is to analyze the development of commercialization of trademark in our country and the state of legislation, aiming to arouse the attention and study of this phenomenon by legislation and academia in our country.
