从我国国情和行政审判实践出发,为了更大限度地保护国家、集体、公民的合法权益,我国的行政公益诉讼制度应具有自身特殊要求。应在起诉、案件适用范围、举证责任分配、级别管辖、公益诉讼的限制等方面做特殊规定,并在行政诉讼领域内对涉及公共利益的案件建立相应的诉讼机构,即由检察机关代表国家追究危害者的行政责任。赋予检察机关对行政公益案件以直接起诉权,以履行检察机关“公益代表人”的职责,依职权主动提起行政公益诉讼或根据公民、法人、其他组织的申诉、控告而提起。赋予公民参与权与监督权,以此协助检察机关发现和确定公益受损害案件并防止其怠于行使行政公诉权。必要时可以推选公民代表参加庭审。
Proceeding from China’s national conditions and administrative trial practice, in order to protect the legitimate rights and interests of the state, the collective and the citizens to a greater extent, our administrative public interest litigation system should have its own special requirements. Special provisions should be made in the prosecution, the scope of application of the case, the distribution of the burden of proof, the jurisdiction of the grade and the limitation of public interest litigation. In the field of administrative litigation, litigation institutions should be set up in cases involving public interest, that is, the procuratorial organs should be prosecuted on behalf of the state Hazard’s administrative responsibility. Empower the procuratorial organs to directly prosecute administrative public welfare cases in order to perform the duties of procuratorial organs and public service representatives, initiate administrative public interest litigation or file complaints based on the powers of the citizens, legal persons and other organizations. Give citizens the right to participate and supervise, so as to assist the procuratorial organs in discovering and determining cases of public damages and preventing them from exercising administrative publicity rights. When it is necessary, civil representatives may be elected for trial.
