情感是社会结构以及文化生成的主要承担者。但由于以往法学研究的基础框架大多建立在情感与理性的两分哲学之上,因此情感在法律中的作用大多被忽视或遗忘。对法律中的情感因素的关注始于哲学家的思考,并继之以法律心理学的实验探索。20世纪90年代中期以后,在由一批法律、社会学、认知科学等方面研究者所主导的学术运动的影响下,以情感为话题的法理学派开始逐渐成形,研究的涉及面和深度得到提高,逐渐脱离了二分法经验主义的局限,转而发展自己独特的解释和研究框架,学科之间的研究也从原来的平行化发展,逐渐呈现出交叉性的态势。
Emotion is the main carrier of social structure and culture. However, since most of the basic framework of legal studies was based on dichotomy philosophy of emotion and reason, the role of emotion in law was largely neglected or forgotten.
