2003年以来,国内法院相继受理了多起MTV的著作权纠纷案件,该类案件引起社会各界广泛关注。上海市第二中级人民法院高度重视MTV案件的审理工作,围绕着MTV案件引发的法律问题,查阅国内外相关资料,多次组织研讨会,广泛听取专家学者、职能部门、行业协会的意见。从本期刊登的该院二位法官撰写的调研文章中,读者可以体会到这一点。在原告正东唱片有限公司诉上海麒麟大厦文化娱乐有限公司关于MTV的著作权纠纷一案判决中,上海市第二中级人民法院认为,判断MTV是否类似摄制电影的方法创作的作品,关键是确定MTV是否具备独创性;对于侵权赔偿数额应综合考虑侵权持续的时间、经营规模、经营场所的位置、侵权人的过错程度、MTV制作的成本和流行程度、当地经济发展状况等因素,酌情予以确定。
Since 2003, domestic courts have accepted many cases of MTV copyright disputes, which have aroused widespread concern in the community. Shanghai No.2 Intermediate People’s Court attached great importance to the trial of MTV cases. Around the legal issues triggered by the MTV case, the Shanghai Intermediate People’s Court reviewed the relevant materials at home and abroad, organized seminars on many occasions and extensively listened to the opinions of experts, scholars, functional departments and trade associations. From the research articles written by two judges of this court published in this issue, readers can understand this point. In the judgment of the plaintiffs Jidong Co., Ltd. v. Shanghai Kirin Plaza Culture & Entertainment Co., Ltd. on the dispute over the copyright in MTV, the Shanghai No.2 Intermediate People’s Court held that the key to determining whether the MTV is similar to a film created by the film production method is to determine the MTV Whether it is original or not; the amount of compensation for infringement should be determined by considering factors such as the duration of infringement, the scale of operation, the location of the business premises, the infringement of the infringer, the cost and prevalence of MTV production, and the local economic development.
