由住房和城乡建设部、国家工商行政管理总局联合发布的2013版《建设工程施工合同(示范文本)》(GF-2013-0201)(以下简称“2013版施工合同”)已于7月1日起正式执行。建设工程施工合同是建设工程的主要合同,是合同当事人在建设工程施工过程中的高行为准则,也是规范承发包双方经济活动、协调彼此工作关系、解决合同纠纷的法律依据,在维护建筑市场秩序、把控工程施工进度、保证工程质量安全等方面作用显著,在建设工程和建设工程招标投标活动中均意义重大。与1999版施工合同相比,2013版施工合同具有很多新的特点,如增加了8项新的合同管理制度,调整完善了合同结构体系,完善了合同价格类型,加强了与现行法律和其他文本的衔接,以保证合同的适用性等,必定能够在工程建设领域发挥更巨大的作用。
