近年来,随着城中村改造工作的不断推进和房价的进一步攀升,以及群众依法维权意识的不断增强,宁波市江东区的集体土地使用权纠纷日益增多,且复杂多样,解决难度大。本文试图结合江东区实际状况,通过集体土地权属争议表现出来的种类分析,指出当前最常用的先行政确认(更正登记)后行政诉讼、先异议登记后民事诉讼这两种土地权属争议解决途径,并结合个人工作体会提出了两点粗浅建议,供大家参考。
In recent years, with the continuous promotion of urban village reconstruction work and the further price hikes, as well as the growing awareness of the masses in safeguarding their rights in accordance with the law, the disputes over collective land use rights in Jiangdong District of Ningbo City have been increasing day by day, and are complicated and diverse. This paper attempts to combine the actual situation in Jiangdong District, through the analysis of the types of disputes manifested in collective land tenure, pointing out that the most commonly used administrative prior to administrative confirmation (registration correction) after the administrative litigation, first dissent after registration of civil litigation of these two kinds of land ownership dispute resolution Ways, combined with personal work experience made two superficial suggestions for your reference.
