本文针对我国市场经济条件下出现的广告违法行为,分析了违法广告的表现形式及影响、违法广告泛滥的原因。通过从系统的观点出发,把广告行为主体、广告法律规范、广告监控机制作为一个整体,努力构建广告违法行为规制系统的总体运作模型,以便发挥整体效益。本文认为要规制违法广告泛滥,就要加强法律法规宣传、完善监督机制、完善贵任追究制度、加强打击力度,以求全面、有效的规制违法广告泛滥。
This article analyzes the illegal forms of advertising and its impact on the illegal acts of advertisements under the condition of market economy in our country and the causes of the proliferation of illegal advertisements. From the system point of view, the main body of advertising, advertising legal norms, advertising monitoring mechanism as a whole, and strive to build an overall regulatory model of advertising operations in order to play an overall efficiency. This article believes that to regulate the proliferation of illegal advertising, it is necessary to strengthen publicity laws and regulations, improve the monitoring mechanism, improve the accountability system, and strengthen crackdown in order to comprehensively and effectively regulate the proliferation of illegal advertising.
