房地产“限购令”作为抽象行政行为,其实质是临时性地利用行政规制手段限制交易数量,进而抑制房屋价格。“限购令”在内容、制定主体和程序方面均缺乏法律依据,不符合行政合法性原则。应当通过制度改革,建立长效机制来解决房地产调控问题。
Real estate “restriction order” as an abstract administrative act, its essence is the temporary use of administrative regulations to limit the number of transactions, and thus curb housing prices. “Restriction order ” in the content, the formulation of the main body and procedures are lack of legal basis, does not meet the principle of administrative legality. Through the system reform, establish a long-term mechanism to solve the real estate regulation and control issues.
