空间作为一种现代资源由其特性理应被《物权法》所采纳,且空间具有独立的利用价值。就空间利用权而言,所体现的是土地分层立体利用与空间分层立体利用的结合。通过剖析空间利用权的内在属性,同时在明晰《物权法》关于土地分层利用规定的局限性基础上,将空间权利与土地权利作理论上的分离,进而体现空间利用的独立价值,也为未来空间利用的发展提供理论支撑。
As a modern resource, space should be adopted by Property Law because of its characteristics, and space has independent use value. In terms of the right to use space, what is embodied is the combination of the three-dimensional utilization of land and the three-dimensional use of space.
