言论自由作为公民权利中最重要的一项权利应受到人们的广泛重视,但目前我们关于言论自由的探讨由于理论和视野的不足以及传统思维模式的影响,我们的探讨广度和深度还有待进步。探析言论自由宪法边界的限制的相关理论,是从一个侧面讨论言论自由相关问题的一种新的尝试。本文首先从言论自由的意义和理论基础来论述言论自由的必要性;其次在论述关于自由边界的基本原则的前提下,从本人和其他人、言论和行动、公共秩序和私人利益三个维度分析影响言论自由宪法边界的因子;接着介绍规制言论自由宪法边界的具体原则和机制——即明显与即刻的危险原则、事前管制与事后管制、场所限制——三个方面的具体内容;然后总结规定言论自由宪法边界的方法——市场决定论的实用主义方法和利益衡量法。最后对于本文的言论自由宪法边界的问题做一小结,以及就此研究的意义和所展现出来的启示作一些理论的分析。 Freedom of speech as the most important right in civil rights deserves our attention.
