近年来,传统农村社会自生的“礼义”、“重道”、“尊老”、“互助”等朴素而富有道德色彩的“民间规范”已经在商品社会下功利主义主导的价值理念和行为标准的冲击下逐渐失去其约束力。另一方面,国家制定法在企图对渐趋式微的“民间规范”实现功能替代、继而重塑乡村社会生活时,却发现这些看似失效的“民间规范”仍然组织着社会生活,规范着人们的行为,并对企图“入侵”的成文法规范表现出了种种不合作。本文试通过一起农村传统赡养纠纷的处理,呈现两种规范贯穿于整个纠纷处理过程的相互影响和角力,进而思考和探寻适合现行农村的新型纠纷解决模式。

On the other hand, when attempting to replace the diminishing “folk norms” and then reshape the social life in rural areas, the national statute found that these seemingly ineffective “civil norms” still organize social life , Regulate people’s behavior and show a variety of non-cooperation with the statutory norms that attempt to “invade.” This paper attempts to deal with the traditional dispute resolution in rural areas by presenting the interaction and conflict between the two norms throughout the process of dispute resolution and then considering and exploring the new mode of dispute resolution suitable for the current rural areas.
