房屋产权是民事主体享有的重要权益。但在我国目前的土地制度下,房屋与土地相分离,房屋产权存在内部矛盾,具有不稳定性。土地所有权制度运行过程中出现公权扩张、主体缺位等情况。同时,现行土地制度对房屋产权影响广泛,房屋产权问题形势不容乐观,例如强拆事件等。文章针对上述问题提出了两种解决模式,其一是改革现有的土地制度,其二是在现有的土地制度基础上,逐步完善配套措施,以期保障房屋产权人的合法权益。
Housing property is the civil rights of the main rights. However, under the current land system in our country, there is an internal contradiction between housing and land and unstable property rights. During the operation of the land ownership system, the expansion of public rights and the absence of the main body occurred. At the same time, the existing land system has a wide range of impact on the property rights of houses, and the housing property rights situation is not optimistic. For example, demolitions and the like. The article proposes two solutions to the above problems. One is to reform the existing land system and the other is to gradually improve the supporting measures on the basis of the existing land system in order to protect the legitimate rights and interests of the property owners.
