我国《反垄断法》第一条明确提出“为了预防和制止垄断行为,保护市场公平竞争,提高经济运行效率,维护消费者利益和社会公共利益,促进社会主义市场经济健康发展,制定本法。”由此可知国家保护消费者权益,维护市场竞争秩序的良好愿望,并从实体法和程序法两个方面构建反垄断法的实施机制,但对消费者权益保护这一方面仍缺乏相应的制度建设,仅在《反垄断法》第50条以“经营者实施垄断行为,给他人造成损失的,依法承担民事责任”进行原则性的赔偿规定,但处于市场弱势地位的消费者在面对经营者的垄断行为时如何更好地利用反垄断法维护自己的合法权益,有待更完善的制度做保证。
