随着文体比赛事业的蓬勃发展,操纵文体比赛的行为日益严重并不断阻碍我国市场经济的健康发展。该类行为的主观过错之恶劣、社会危害之巨大,要求我们必须借助刑法对其进行定罪处罚。然而,目前我国刑法体系还不完善,对文体比赛领域的立法重视度不足,导致相关犯罪行为仍得不到有效制裁。因此,完善我国现有刑法之罪名,尝试设立新罪对该类行为进行处罚是本文的主旨所在。 With the vigorous development of sports events, the acts of manipulating style competitions have become more and more serious and they have continuously hindered the healthy development of China’s market economy. The bad subjective fault and the great social harm of such acts require that we must convict and punish them with the help of criminal law. However, at present, the criminal law system in our country is still not perfect, and the legislation in the field of sports competition is not enough, which leads to that the relevant criminal acts are still not effectively sanctioned. Therefore, perfecting the existing criminal law in our country and attempting to set up a new crime to punish such behavior is the main point of this article.
