建筑物区分所有权是一项重要的不动产物权。业主的建筑物区分所有权,包括了3个方面的基本内容:专有所有权、共有所有权和成员权。它们既是相对独立的权利,又是一个不可分的整体。而专有所有权作为其中的占主导地位的权利,是作为制度的区分所有权的单独性灵魂。我国物权法及最高人民法院法释[2009]7号文中对专有所有权的性质、范围及侵害专有所有权的救济方式进行了规定。
Building ownership differentiation is an important property right. The owner’s building distinguishes ownership and includes three basic elements: exclusive ownership, ownership and membership. They are both independent rights and an indivisible whole. Proprietary ownership, as one of the dominant rights, is the separate soul of ownership as a system. The Property Law of our country and the Supreme Court Interpretation [2009] No. 7 stipulate the nature and scope of exclusive ownership as well as the remedies against proprietary rights.
