由于我国社会老龄化速度不断加快,加之社会保障体系的不尽完善,使社会保障的覆盖面和保障程度都较低,并且推行的计划生育政策造成的家庭“421”不平衡结构,使社保体系转型成本转嫁到社会中坚层面。借鉴西方的住房反向抵押贷款政策可有效弥补我国养老保险体系的不足,并在我国某些地区得到试行,但由于我国城镇土地国家所有,农村土地集体所有的土地制度,以及政府为缓解住房供求矛盾而推行的经济适用房、小产权房等政策,为这种养老保险方式的施行制造了障碍,本文主要说明反向抵押贷款在我国实施过程中存在的物权问题,并借鉴香港“反按揭”的处理经验对反抵押方式在我国推行提出建议。
