我国不动产风险负担模式颇有争议,通说采交付主义,少数说采所有权主义,国外立法沿革亦有类似争议。交付主义与所有权主义孰优孰劣,争议焦点多在基本价值理念、风险的概念界定等方面,鲜有学者论及不同模式在不同法律环境中的运行状况。笔者从案例模型出发,以不同风险负担模式在国内外立法例的体系兼容性为考察对象,探究何种模式为宜,以期揭示《合同法》第142条的内涵,并为民法典的制定提供借鉴意义。
China’s real estate risk burden model is quite controversial. It is said that there is a similar controversy over adoption of delivery and delivery, the minority’s assertion of ownership and the evolution of foreign legislation. There are few scholars on the operational status of different modes in different legal environments such as basic value concept and definition of risk. Starting from the case model, the author examines the system compatibility of different risk burden models at home and abroad, and explores which mode is appropriate in order to reveal the connotation of Article 142 of the Contract Law and provide it for the formulation of the Civil Code Reference meaning.
