在我国城乡土地二元管理格局下,城市国有土地使用权流转已经形成成熟的市场模式,而农村集体土地流转却受到严格管制,随着城市化进程的不断推进,城乡用地矛盾日益凸显,不少问题和弊端日益显露。2013年,十八届三中全会决定要求建立城乡统一的建设用地市场,对于农村土地征收、集体经营性建设用地入市和宅基地制度改革等方面提出了新的要求,一时集体建设用地使用权的流转问题已成为学术讨论的热点话题。其中,法律问题成为重中之重的问题。
