我国现行农村宅基地指的是农村房屋所附着的地面土地,农村宅基地使用权不仅是我国特有的一项用益物权,而且是农民所享有的一项基本权利。近年来我国城镇化建设高速发展,农村进城务工人员日渐增多,使得农村宅基地使用权流转中存在的问题不断显现,亟待完善与解决。本文从农村宅基地使用权的法律性质出发,对农村宅基地使用权流转机制的完善进行法律探讨,促进农村宅基地流转的规范化与制度化,使其通过流通达到效率最大化。
The current rural residential land in our country refers to the ground land attached to rural houses. The right to use rural house sites is not only a usufructuary right unique to our country, but also a basic right enjoyed by peasants. In recent years, with the rapid development of urbanization in our country, the increasing number of migrant workers in rural areas has made the problems existing in the transfer of the right to use homesteads in rural areas continue to emerge and are urgently needed to be improved and solved. Based on the legal nature of the right to use house sites in rural areas, this paper discusses the improvement of the circulation mechanism of the right to use homestead in rural areas, and promotes the standardization and institutionalization of the transfer of rural house sites so as to maximize the efficiency through circulation.
