房屋买卖中介服务合同并不能简单地一律定性为居间合同,而应当根据房屋中介服务合同中约定的义务内容确定该合同的性质。如果合同约定的中介方之义务只有促成委托人订立合同的机会或者提供订立合同的媒介服务之义务,那么该合同就是居间合同;如果该合同中约定的中介方之义务除了促成委托人订立合同的机会或者提供订立合同的媒介服务之义务外,还有其他义务内容,那么,该中介服务合同是委托合同或者是兼具居间合同和委托合同性质的复合合同,可称之为房地产经纪合同。
