本文基于“产权理论”提出明确小区车位、车库物权的法经济学理论基础,并从物权法解释论视角,论证以《物权法》第74条所确立的“二元分类”作为实践中解决小区车位、车库权利归属基础原则的合法性、正当性和可行性。最后,本文提出以信息公开作为保障业主权利的辅助性政策,以解决“二元分类”标准可能的负面效应。
Based on the theory of property rights, this paper puts forward the legal and economic theoretical basis for defining the parking space and garage real right of residential quarters. From the perspective of the interpretation of property law, this paper argues that the “binary classification” established in Article 74 of the “Property Law” In the settlement of parking spaces, parking rights attribution of the basic principles of legitimacy, legitimacy and feasibility. Finally, this paper proposes to use information disclosure as an auxiliary policy to protect the rights of owners to solve the possible negative effects of the “binary classification” standard.
