城镇住房制度改革使得老旧小区的产权形式多样化,形成了专有权和共有权分离的复杂产权结构。专有权和共有权分离的不正常状态导致老旧小区管理权难以行使。必须从老旧小区的产权现状出发,构建与产权结构相适应的准业主组织,形成老旧小区管理的长效机制。
The reform of housing system in urban areas has diversified the forms of property rights in the old residential quarters and formed a complicated structure of property rights with the separation of exclusive rights from common ones. The abnormal state of the separation of the exclusive right and the common right has made the management of the old district difficult to exercise. We must proceed from the status quo of property rights in the old residential area to build a prospective owners’ organization that is compatible with the property rights structure and form a long-term mechanism for the management of old residential areas.
