学历学位和职业证书是一个人知识水平、技术能力的凭证,代表着一个人在经济社会中获得经济收入的水平,具有潜在的巨大经济价值。在婚姻关系存续期间,夫妻一方为另一方接受教育,获得学历学位或职业证书而提升个人技能付出了成本,做出己方利益的牺牲和代价。获得证书及技能提升的持证方在对方的付出和帮助下提升了收入能力,但在离婚时却得不到证书带来的利益。因此,本文认为在夫妻离婚时分割文凭,才能真正平衡夫妻双方的利益,达到法律追求的公平。 Academic degrees and professional certificates are certificates of a person’s knowledge and skills. They represent a person’s level of economic income earned in economic and social situations and have enormous potential economic value. During the marriage, the spouse pays for the cost of gaining one’s skills by acquiring education, diploma or diploma and making sacrifices and costs for one’s own benefit. The certificate holder who gains the certificate and the skill enhancement enhances the income ability with the other party’s giving and helping, but at the time of divorce, the certificate benefits are not obtained. Therefore, this paper believes that when the divorce divorces, the couple can really balance the interests of both husband and wife, to achieve the fairness of the law.
