我国《物权法》第136条对于建设用地使用权的设立的规定可以视为我国对于空间地上权的规定——建设用地使用权可以在土地的地表、地上或者地下分别设立。由此看出我国是承认空间地上权的,但是我国对于空间地上权的法律规定是有一定缺陷的,这也导致了社会生活中面临实际的空间地上权问题时不能很好的得以解决,进而引发了一些问题。
