我国已将PPP项目社会资本合作方的选择纳入政府采购管理制度,因此在加入WTO《政府采购协议》谈判背景下,适时将PPP领域纳入GPA出价,逐步降低外资机构的市场准入门槛,进一步开放国外资本参与我国PPP项目将成为发展趋势。然而,外资机构为PPP项目带来资金以及先进管理运营经验的同时,也将挤占国内社会资本的市场空间,对我国相关产业及市场主体形成一定挑战。由于PPP项目主要分布在基础设施、公用事业等领域,部分涉及国家安全和公共利益,因此部分PPP项目应对外资给予适当保留。本文结合我国PPP项目利用外资历程,分析了我国加入GPA的谈判进展、GPA参加方PPP领域出价及影响,并从经济和制度两个方面剖析了PPP项目引进和利用外资的重要意义,就WTO《政府采购协议》谈判背景下PPP项目利用外资问题提出对策建议。
China has included the choice of social capital partners in the PPP project into the government procurement management system. Therefore, under the negotiation of the “Government Procurement Agreement” of China’s accession to the WTO, the PPP area should be included in the GPA bidding in a timely manner to gradually lower the market access threshold for foreign-funded institutions and to further liberalize Foreign capital to participate in China’s PPP project will be the development trend. However, as foreign-funded institutions bring capital and advanced management and operation experience to PPP projects, they will also squeeze the market space for domestic social capital and pose some challenges to the relevant industries and market players in China. As the PPP projects are mainly distributed in the fields of infrastructure and public utilities, and some are related to national security and public interest, some PPP projects should appropriately retain foreign investment. Based on the experience of using foreign capital in our PPP project, this paper analyzes the progress of the negotiation of joining GPA in our country and the bidding of GPA in the PPP field. It also analyzes the significance of PPP project introduction and utilization of foreign capital from two aspects of economy and system, Government procurement agreement "PPP project under the background of the use of foreign investment put forward countermeasures and suggestions.
