十八届三中全会指出,减少政府对社会产品的提供,增加社会组织对社会产品的提供。积极发展社会组织在农村跨行政区域管理中的作用,有利于实现政府治理与社会自我调节,增强农村的发展活力,提高社会的治理水平。2015年中央一号文件指出,加快构建新型农业经营体系。坚持和完善农村基本经营制度,坚持农民家庭经营主体地位,引导土地经营权规范有序流转,创新土地流转和规模经营方式,积极发展多种形式适度规模经营,提高农民组织化程度。社区利益型综合农协作为社会组织,是发展农业适度规模经营的新形式。对于综合农协的探讨研究成果多集中于农业经济学和社会学领域,以法学为视角对其进行研究的著作寥寥无几。笔者旨在以法学为视角,立足于我国农村合作组织发展的现状,对我国的综合农协进行制度构建。

Adhere to and improve the basic management system in rural areas, adhere to the mainstay of the peasant family business, and guide the orderly circulation of land management rights, innovation in land circulation and scale management methods, and actively develop various forms of moderate scale management, improve peasant organization. As a social organization, the community-based integrated agricultural cooperatives are a new form of developing moderately-sized agriculture. There are few works on the research of integrated agriculture association. Most of the research results are concentrated on agricultural economics and sociology, and from the perspective of law science. The author aims to take legal science as the perspective, based on the development of China’s rural cooperative organizations in the status quo, China’s comprehensive agricultural association system.
