域外驻军是指屯驻、停留在一国主权管辖领域之外成建制的军队。和平时期域外驻军应尊重自由同意、协商、豁免、尊重驻地法律和授权等五项主要原则。和平时期域外驻军还受到与禁止和限制军事行动有关的国际法规则的制约。司法管辖权的分配是关系域外驻军的核心法律问题。派遣国通常具有刑事专属管辖权,在并行管辖的情况下要明确优先管辖的条件;民事管辖权的分配通常在区分政府间求偿与个人求偿,区分职务行为与非职务行为,区分当事国与第三方的基础上做到灵活处置。
