美国公用土地征收严格依照宪法运行,曾一度被誉为政府征收规范化和效率化的典范。但随着美国近年经济社会发展,土地征收严重受到补偿自身的限制。在力求公平市场价值补偿原则下,土地征收逐渐显露出了它的某些局限性。为应对这些局限性,美国的相关学者们提出了趋于市场化的获取公共土地的替代机制:秘密购买机制、土地集中区制度、拍卖机制。这些替代机制对我国素有诸多诟病的土地征收来收来说,相信会有一定的借鉴意义。
The collection of public land in the United States strictly in accordance with the constitutional operation, once known as the government collection of standardization and efficiency of the model. However, with the economic and social development in the United States in recent years, land expropriation is severely limited by its own compensation. Under the principle of compensation for fair market value, land expropriation gradually revealed some of its limitations. To deal with these limitations, the relevant scholars in the United States put forward the market-oriented alternative mechanism for acquiring public land: the secret purchase mechanism, the system of land concentration centers and the auction mechanism. These alternative mechanisms for our country has many criticisms of the land expropriation to close, I believe there will be some reference.
