已签二次固定期限劳动合同后,劳动者若要求续签无固定期限劳动合同,用人单位有权不同意续签而加以拒绝吗?续订的条件到底是什么?只需劳动者单方同意还是需要劳动者与用人单位双方同意?本文从续签合同的两种不同结果出发,从司法实践对这一问题的处理着手,通过对无固定期限劳动合同的功能和立法目的探讨,去寻求劳动合同法第十四条第二款第(三)项的立法真意,希望在法制统一的我国不再出现对同一法律问题有不同甚至是相反的司法处理结果。
