房地产登记是通过政府行为对私权的确认与保护,该制度对保护房地产交易权利人的物权、维护交易安全具有重要意义。我国《物权法》的出台虽然使房地产登记制度具有了基本统一的理论架构,但房地产登记制度本身的设计还存在着诸多疏漏,如房地产登记行为的行政管理色彩浓厚、分别登记制度造成多头多级管理,以及登记机关的审查标准不明确等,在实际操作中产生了很多问题。应当从颁布统一的房地产登记法、建立统一的房地产登记机关、明确审查标准等方面进行改进,以促进房地产登记制度的完善。
