今年7月1日,期待已久的《中华人民共和国侵权责任法》(以下简称《侵权责任法》)正式实施,其中第34条和第35条关于“老板”--用人单位或个人雇主对其工作人员或个人雇员的侵权行为承担责任的法律新发展,使受害人在维权时省去了不少不必要的麻烦。所谓替代责任,是相对于自己责任的一种特殊侵权法律后果,体现为行为人不是就自己侵权行为所造成的损害后果对他人承担责任,而是对于第三人实施的侵权行为对他人承担责任,例如,用人单位就其工作人员因执行工作任务的侵权向受害人承担责任。
