社会主义市场经济的发展,离不开城市化建设,城市的发展必将进行新城区拓展及旧城区改造,也就必然会涉及房屋拆迁问题。近年来,我国房屋拆迁纠纷逐年增多,且有激化迹象。而根本原因在于我国对房屋拆迁的法律性质没有进行相应明确的界定,立法对于房屋拆迁的规范存在一定的缺陷,造成了不和谐的一面,本文主要浅析城市房屋拆迁中依据拆迁目的不同,分为公共利益与非公共利益拆迁的相关法律问题,以此期望对完善我国城市房屋拆迁制度提供一定的帮助和建议。
The development of the socialist market economy can not be separated from the urbanization. The development of the city is bound to carry on the expansion of the new city and the renovation of the old urban area, and it will inevitably involve the issue of house demolition. In recent years, China’s housing demolition disputes have increased year by year, and there are signs of intensification. However, the fundamental reason is that our country does not define the legal nature of house demolition clearly. The legislation has certain flaws on the standard of house demolition and creates a discordant aspect. This paper analyzes the demolition of urban housing in accordance with the different purposes of demolition For the public interests and non-public interests of the demolition of the relevant legal issues, with the expectation to improve China’s urban housing demolition system to provide some help and advice.
