混淆可能性理论是以保护商标的标识功能、商标与商品之间的联系以及经营者建立的商誉为基础的,该理论与《商标法》的立法目的一致,因此混淆可能性应当是认定商标侵权的核心要件。本文分两部分,第一部分介绍了混淆可能性理论,包括传统混淆可能性理论、售前混淆、售后混淆。第二部分对混淆可能性理论在我国商标侵权认定中的立法及司法现状进行了分析。
The theory of confusion possibility is based on the function of trademark protection, the connection between trademark and commodity, and the goodwill established by the operator.
