农村住房抵押相关问题在我国的法律制度中尚无明确规定,2015年12月经第十二届全国人民代表大会常务委员会第十八次会议决议,授权国务院在天津蓟县等59个县开展农民住房抵押权试点工作,这是我国农村住房抵押权在法律制度中试探性的前进,对于农村住房财产抵押工作的开展以及法律制度的完善都具有十分重要的作用。然而,处在探索阶段的农村住房抵押权问题,不管是法律规制方面的匮乏,还是政策规制中的不统一,其发展仍然步履维艰。本文主要以当前的农村住房财产抵押试点地区的实践为基础,分析了当前我国农村住房财产权抵押在法律制度方面存在的问题并对法律制度的构建和完善提出了一定的建议。

This paper mainly based on the current practice of rural housing property mortgage pilot areas, analyzes the existing problems in the legal system of rural housing property rights mortgage in our country and puts forward some suggestions on how to build and perfect the legal system.
