随着经济全球化发展和国际民商事案件管辖权冲突,不方便法院原则正被越来越多的国家与地区所接受.我国虽然不像英美法系国家拥有宽泛的管辖权,但我国也并非传统的大陆法系国家,在不方便法院原则的适用问题上并不存在宪法性障碍.对不方便法院原则的产生与发展进行研究,深刻的挖掘不方便法院原则的内在的本质要求是很有必要的.结合世界发展局势以及我国当前立法的前沿的具体问题进行研究,得出我国应当引入适用不方便法院原则的结论,无疑是正确的.
