我国房屋限购令实施至今虽然在房地产交易和房价两方面发挥了行政控制作用,给过热的楼市降了温,但是在实施执行过程中也出现众多新问题,让大众对其法律性质产生了质疑。房地产市场调控必须注重实效且手段正当,因为房屋限购令隶属行政手段,所以可将其纳入现行法律体系,使其合法。
Although the implementation of the housing purchase order in our country has played an administrative and control role in the real estate transaction and house price so far, the overheated property market has dropped in temperature. However, many new problems have emerged in the process of implementation and enforcement, which has challenged the public’s legal nature. The regulation of the real estate market must be pragmatic and proper in means. As the housing restriction order is subordinated to administrative means, it can be incorporated into the existing legal system to make it lawful.
