人才已经成为企业竞争的第一要素,众多掌握核心管理与技术经验的高管频繁跳槽也获得了广泛关注。企业高管往往掌握着一家企业的核心竞争力,如果处理不当,很容易产生企业之间的恶意竞争。目前,我国针对研究竞业限制已经有了较多的研究成果,但是对于企业高管这一特殊职业团体并未有针对性的研究,本文将针对目前我国高管竞业限制制度存在的问题进行原因分析并提出相关法律规制建议。
