虚假广告的滋生与蔓延,如同环境污染、社会犯罪一样,正日益侵蚀着我们社会经济生活各个方面的健康肌体,造成了严重的社会危害。考察虚假广告产生的原因,除了与社会转型期的变革有关外,还与我们的法律救济存在缺陷有很大的关系。对此,笔者认为,虚假广告的法律救济,一是要加大对虚假广告的处罚力度;二是要严格广告审查程序;三是要严格执法,消除地方保护主义;四是倡导消费者的自我法律保护意识。
The breeding and spread of false advertisements, like environmental pollution and social crimes, are increasingly eroding the healthy muscles in all aspects of our social and economic life and have caused grave social harms. Investigating the causes of false advertisements is not only related to the transformation in the social transition, but also has a great relationship with the flaws in our legal remedies.
