一、行政案卷排他性原则的意义行政案卷排他性原则是英美法系国家行政法的一项重要原则,尤以美国为典型。《美国联邦行政程序法》第556条第5款规定:“书面证言、物证,以及在该程序中收入案卷的全部文书和申请书,就构成了本编第557条所规定的作为决定之依据的案卷。当事人只要交纳法定成本费,就有权得到其副本。”具体而言,行政案卷是指一项行政决定作出时与其相关的全部记录和文件,包括听证记录、调查笔录等,也包括关于行政决定本身的文字记录或文件等。行政案卷具有程序性、惟一性、封闭性、客观性和整体性等特点。而行政案卷排他性原则是指,行政机关的行政决定只能以案卷作为根据,不能在案卷以外,以当事人所未知悉的和未论证的事
