随着近几年劳动者工伤维权事件的屡屡报道,关注工伤私了协议的讨论也愈来愈热。用人单位和劳动者私下签订的私了赔偿协议是否具有法律效力,劳动者后期想要撤销是否可以?这一系列的疑问都指向工伤私了协议的效力研究。因此本文以具体的案例分析阐述工伤私了协议的效力问题,以期对工伤私了协议的纠纷处理予以指导。
With the reports of laborers’ grievances and injuries in recent years, the discussion of agreements on work-related injuries has become increasingly hotter. Has the employer and the employee privately signed a private compensation agreement have the force of law and is it possible for the worker to withdraw later? The series of questions all point to the study of the efficacy of private contractual agreements. Therefore, this article elaborates the effectiveness of the private contract of work-related injury with the specific case analysis, with a view to guiding the dispute handling of personal injury agreement.
