ACTA即反假冒贸易协议,是一个主要针对商品假冒和盗版问题的诸边贸易协议,旨在协议成员方之间建立一个知识产权执法实施的新标准。文章从民事执法和刑事执法角度对ACTA与TRIPS进行比较,指出ACTA并未实质扩大TRIPS的内容却提高了执法标准,对此我国必须给予足够重视。 ACTA is the Anti-Counterfeit Trade Agreement, a plurilateral trade agreement that deals primarily with counterfeiting and piracy of goods, aiming to establish a new standard of enforcement of IPR enforcement among its member states. The article compares ACTA with TRIPS from the point of civil law enforcement and criminal law enforcement. It points out that ACTA does not substantively expand the content of TRIPS but enhances the standard of law enforcement. Therefore, China must pay enough attention to it.
