聆询是公安部设立的一种新的劳动教养审批制度。聆询属于广义的听证程序,又是准司法审判程序。聆询的价值主要体现为平衡、平等,公正,效率,廉政等。聆询制度的主要原则是公开、公正、职能分离、事先告知等。从执法实践看,聆询制度尚存在着原则要求、根本目的、价值宣传、程序作用等方面的缺失。在实践环节完善聆询制度的途径是加大聆询宣传力度;增强民警人权意识;保证聆询公正透明;建立聆询效力制度。
The hearing is a new reeducation through labor system set up by the Ministry of Public Security. Hearing is a generalized hearing procedure, which is a quasi-judicial trial procedure. The value of the hearing is mainly reflected in the balance, equality, fairness, efficiency and integrity. The main principles of the system of inquiry are openness, fairness, separation of functions and prior notification. From the point of view of law enforcement practice, there are still some defects in the system of inquiry, such as the principle requirement, the fundamental purpose, the value propaganda and the procedural function. The ways of improving the system of hearsay in practice are to step up publicity; to raise awareness of human rights in police; to ensure fairness and transparency in the hearing; and to establish a system of the effectiveness of the hearing.
