随着生物技术的迅猛发展,遗传资源作为一国重要的战略物资,不仅在解决粮食、健康和环境问题方面发挥着重要作用,而且在商业上具有重大的经济价值,它已经成为各国争夺的目标。“生物剽窃”现象是目前包括中国在内许多发展中国家共同面临的一个日益严峻的问题。针对我国的现实情况,我国遏制“生物剽窃”的法律制度完善措施有:确认国家所有的遗传资源的权属制度;建立资源获取与惠益分享的专门法律;加强遗传资源保护的国际合作。 With the rapid development of biotechnology, as an important strategic material for a country, genetic resources have not only played an important role in solving the food, health and environment problems but also have great economic value in commerce. It has become the target of various countries’ contention . The phenomenon of “biological plagiarism” is a growing problem that many developing countries, including China at present, face together. In view of the reality of our country, the legal measures to curb “biopiracy” in our country include: identifying the ownership system of all state-owned genetic resources; establishing specific laws on access and benefit-sharing; and strengthening international cooperation in the protection of genetic resources .
