涉及房地产登记的行政赔偿案件,大部分是由交易一方当事人的民事欺诈行为和房地产登记部门的错误登记行为共同造成另一方当事人权利受损而引发。在这种混合侵权的情况下,行政赔偿和一般民事侵权赔偿责任应当如何分担和衔接成为困扰司法界的一个难题。文章从房地产错误登记行政赔偿的依据、赔偿的范围、责任分担及赔偿方式等方面进行分析,也指出了亟待明确的问题。
The administrative compensation cases involving real estate registration are mostly caused by the civil fraud of one party to the transaction and the wrong registration of the real estate registration department resulting in the damage to the rights of the other party. Under this kind of mixed infringement, how to share and link responsibility of administrative compensation and general tort liability becomes a difficult problem for the judiciary. The article analyzes the basis of the real estate wrong registration of the administrative compensation, the scope of compensation, the sharing of responsibility and the ways of compensation, and also points out the problems to be solved urgently.
