自从最高人民检察院出台了关于检察机关提起公益诉讼的试点方案之后,实践中检察机关提起环境公益诉讼的数量大幅攀升,在环境问题日益严峻的今天,检察机关提起环境公益诉讼能够为解决环境问题开辟一条新的道路。然而由于检察机关提起环境公益诉讼在立法中并没有法定地位,因此,立法者应当在主体资格界定、责权范围划分、调查取证权力、相互配合义务、跨区起诉程序等五个方面对现有立法加以完善,这样才能够使检察机关提起环境公益诉讼制度更加规范。
