不动产金额较大,直接关系人民及国家的经济利益,对人民的切身利益产生直接影响,而善意取得制度有利于确保不动产交易安全性及有效性。不动产是否适用善意取得制度,国内外对其的规定各有不同,而国内各个学者观念也有所不同。因此,探究不动产善意取得制度实施具有极为重要意义。研究表明,该制度可有效对受让人的合法权益进行有效保护,进而确保交易过程中的安全性及合法性。本文首先分析善意取得制度的概念,然后分析其使用范围及必要性,最后指出具体的应对措施。
The larger amount of real estate directly affects the economic interests of the people and the country and has a direct impact on the vital interests of the people. The system of goodwill acquisitions is conducive to ensuring the safety and effectiveness of real estate transactions. Whether the real estate is good-faith acquisition system, the provisions of its different at home and abroad, and domestic scholars have different concepts. Therefore, to explore the implementation of good faith acquisition of real estate is of great importance. The research shows that the system can effectively protect the assignee’s legitimate rights and interests and thus ensure the safety and legality of the transaction. This article first analyzes the concept of bona fide acquisition system, then analyzes the scope and necessity of its use, and finally points out the specific countermeasures.
