近年来,随着饿了么、大众点评、美团等网络食品交易第三方平台(本文主要探讨外卖平台)的发展,第三方平台之间竞争不断加剧,其中食品安全问题也不断涌现,对网络平台消费者的人身财产安全造成了严重威胁。当消费者由于网络外卖平台商家的行为造成了消费者权益损害时,网络外卖平台是否应当承担责任,应当如何承担责任。本文将从现有实践出发,介绍网络外卖平台的运作模式,分析网络外卖平台上存在民事法律关系,从理论和立法出发分析网络外卖平台对于在其平台上注册商户的责任承担问题进行分析梳理,并从中提出立法建议。
