当前企业转制中出现的劳动争议较多,其中涉及清退企业富余职工的经济补偿金问题尤为突出。究其原因,一是有的地方政策细节与国家政策有出入。有的地方政府为了推动企业转制,结合当地的实际情况相应出台了一些政策,这是完全必要的,但是不能因此而忽视了《劳动法》的贯彻执行。二是经济补偿金由谁来支付。卖方与转制企业或是互相扯皮,或是搁置不理,引发争议后,责任归属问题上相互推诿,损害了职工的合法利益。
At present, there are more labor disputes arising from the restructuring of enterprises. Among them, the issue of economic compensation involving remuneration of surplus workers of enterprises is particularly prominent. The reason, first, some local policy details and national policies are different. In order to promote the restructuring of enterprises, some local governments have correspondingly introduced some policies in light of the actual conditions on the ground. This is totally necessary, but it can not therefore neglect the implementation of the Labor Law. Second, who should pay the economic compensation? The sellers and the restructuring companies either buckled each other or left unwarranted controversy, the issue of attribution of responsibility to promote each other, undermining the legitimate interests of workers.
