无论是从比较法的视野还是从价值论的角度上看,在我国的法律体系中构建异议登记制度是必要而迫切的。这一观点在《物权法》制订过程中也得到了采纳。如今摆在我们面前的问题是如何把这种制度设计的更合理和完善。本文认为,《物权法》对异议登记的规定是不够妥当的,把异议登记仅仅作为不同意更正登记的一种救济方式不利于发挥该制度的价值。再者,《物权法》规定的条文过于原则和笼统,不利于将异议登记制度付诸实践,需要在立法中给予明确和细化。本文针对如何在我国构建一个合理的异议登记制度作详细论述。 From the perspective of comparative law or value theory, it is necessary and urgent to build an opposition registration system in the legal system of our country. This view has also been adopted during the formulation of the Property Law. The question before us today is how to make such a system more rational and perfect. This article argues that the provisions of the Property Law for opposition registration is not proper enough, and that the registration of objections merely as a remedy that does not agree to correct the registration is unfavorable to the value of the system. Furthermore, the provisions stipulated in the Property Law are too general and general, which is not conducive to putting the opposition registration system into practice and needs to be clarified and refined in the legislation.
